Stay by Inhabit – Terms of Service

Welcome to Stay by Inhabit (“Stay,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the Stay by Inhabit website, platform, and services (collectively, the “Platform”).

By accessing or using the Platform, you agree to these Terms.

1. Platform Overview

Stay by Inhabit provides a technology platform that allows users to discover and book vacation rental properties managed by third-party property management companies (“PMCs”).

Important:
Stay by Inhabit isnot the owner, operator, or manager of any property listed on the Platform.All properties are owned and/or operated by independent PMCs.

Stay acts solely as afacilitator of bookingsbetween you and the PMC.

2. Eligibility & Use

By using the Platform, you confirm that:

  • You are at least 18 years old
  • You have the legal authority to enter into agreements
  • You will provide accurate and complete information

You agree not to:

  • Use the Platform for fraudulent purposes
  • Interfere with or disrupt the Platform
  • Attempt to access restricted systems or data

3. Booking & Payments

3.1 Booking Confirmation

A booking is confirmed once payment is successfully processed and a confirmation is issued.

3.2 Payments

Payments may be processed by:

  • Stay by Inhabit
  • The PMC
  • A third-party payment processor

All charges will be disclosed at checkout.

3.3 Fees & Taxes

Bookings may include:

  • Rental charges
  • Taxes (including occupancy or lodging taxes)
  • Service or platform fees

4. Cancellation & Refunds

All reservations are subject to the cancellation policy of the applicable PMC.

Key Terms:

  • Cancellation policies vary by property and will be presented at or before booking
  • Refunds are not guaranteed
  • Stay by Inhabit reserves the right to apply additional restrictions or limitations on refunds

In the event of a dispute regarding cancellations or refunds, the PMC’s policy will govern, subject to applicable law.

5. Property Listings & Accuracy

Property details, descriptions, photos, amenities, and availability are provided by PMCs.

While we strive for accuracy:

  • Stay doesnot guaranteethat listings are complete, accurate, or up to date
  • Differences between listing details and actual property conditions may occur

6. Role of Stay by Inhabit

Stay by Inhabit:

  • Facilitates discovery and booking
  • Provides platform functionality

Stay by Inhabit doesnot:

  • Own, manage, or control properties
  • Guarantee property condition, safety, or suitability
  • Act as an agent for the guest or PMC

All stays, services, and experiences are provided directly by the PMC.

7. Guest Responsibilities

You agree to:

  • Comply with all rules set by the PMC
  • Respect the property and surrounding community
  • Pay for any damages caused during your stay

Failure to comply may result in:

  • Cancellation of your booking
  • Additional charges
  • Removal from the Platform

8. Disclaimers

To the maximum extent permitted by law:

  • The Platform is provided “as is” and “as available”
  • Stay disclaims all warranties, express or implied
  • Stay does not guarantee uninterrupted or error-free operation

9. Limitation of Liability

To the fullest extent permitted by law:

Stay by Inhabit shall not be liable for:

  • Property-related issues (cleanliness, maintenance, safety, etc.)
  • Acts or omissions of PMCs
  • Cancellations, delays, or interruptions
  • Loss of enjoyment, travel disruptions, or indirect damages

Our total liability, if any, shall not exceed the amount paid through the Platform for the applicable booking.

10. Indemnification

You agree to indemnify and hold harmless Stay by Inhabit and its affiliates from any claims, damages, or losses arising from:

  • Your use of the Platform
  • Your stay at a property
  • Your violation of these Terms

11. AI & Automated Content

Stay by Inhabit may use artificial intelligence or automated systems to:

  • Recommend properties
  • Generate content or summaries
  • Assist with search and booking

Such outputs:

  • May not always be accurate or complete
  • Should not be solely relied upon

12. Third-Party Services

The Platform may integrate with or rely on third-party services, including:

  • Payment processors
  • Property management systems
  • External partners

Stay is not responsible for the performance or actions of these third parties.

13. Termination

We may suspend or terminate access to the Platform if:

  • You violate these Terms
  • You engage in fraudulent or harmful activity

14. Governing Law & Dispute Resolution
